Together, the Website and App and CreationsRewards are collectively known as the "Services". 1. Acceptance of Privacy Policy

By accessing or using the Services, you agree to this Policy. If you do not agree, do not use the Services. Where required by law, we will obtain your consent before processing your personal information for the purposes described in this Policy. This Policy does not apply to information collected offline or by third parties that are not acting on our behalf.

To the extent that we provide you notice on the Website or App of different, or additional, privacy policies or practices (at the point of our collection), then those additional terms shall govern such data collection and use.

Read this Policy carefully, to understand our policies and practices regarding your information, and how we will treat it. We may update this Policy. When we make material changes, we will post the revised Policy with a new "Last Revised" date and, where required by law, provide additional notice (for example, by email to registered users). Material changes will not apply to Personal Information collected under a prior version of the Policy unless we obtain consent or otherwise have a lawful basis to do so.

3. What Information Do We Collect, and When Do We Collect It?

a. We collect the following categories of Personal Information: Identifiers (name, email, postal address, phone number, device identifiers); Account Data (username, password, account preferences, User ID); Transactional Data (reward redemptions, transaction data related to Third Party Opportunities, tax information such as SSN when required for tax reporting); Profile and Demographic Data (age, gender, postal code, education, employment); Communications (messages you send to us); Technical and Usage Data (IP address, browser type, operating system, pages visited, referral URL, cookies, advertising identifiers, geolocation where enabled). We do not intentionally solicit sensitive categories such as race, health, or biometric data; if you voluntarily provide such data we will treat it as Personal Information and obtain consent where required.

b. What Information Does the Service Collect?

When you visit our Website, utilize our smartphone app, or otherwise access CreationsRewards (our "Services"), we may collect two types of information about you: (i) information that can be used to identify you, such as your first and last name, e-mail address and home address ("Personal Information"), and (ii) information related to your activities on our Services that is automatically collected as you interact with our Services ("Usage Information").

c. Personal Information You Voluntarily Provide.

Generally, you can visit our Services (example: website or app) without telling us who you are, and without giving us any Personal Information. The only way that we collect Personal Information through our Services is if: (i) you register for an account; (ii) you send us a message; (iii) in connection with our verification of your information relating to your account; (iv) if you need to provide us Personal Information in connection with delivery of a reward (e.g. we need a valid physical address if you request a physical gift card instead of an electronic gift card); (v) you are a United States member and you notify us that you have redeemed rewards with a value of $600 or more in any calendar year, and you provide us with your social security number so that we can send you the proper tax form; or (vi) if you otherwise voluntarily provide such information through the Services via the CreationsRewards Website or App.

We will collect whatever Personal Information you voluntarily provide (e.g., name, phone number, postal address, and/or e-mail address). Likewise, if you send us a message, you will be sending us your name, e-mail address, and any other information, including Personal Information, you choose to include in that communication.

You are under no obligation to provide Personal Information, but if you elect not to provide it, you may be unable to collect incentives or redeem rewards or use certain features of, or communicate with us, via our Services.

d. Information We Collect or Store as You Access and Use the Website.

In addition to any Personal Information or other information that you choose to submit to us via our Services, we and our third-party service providers may use a variety of technologies that automatically (or passively) store or collect Usage Information. This Usage Information may be stored or accessed using a variety of technologies that may be downloaded to your personal computer, laptop, tablet, mobile phone or other device (each, a "Device") whenever you visit or interact with the Website. Usage Information typically is anonymous information not associated with you or your identity. However, if Usage Information is combined with your Personal Information in a manner that it is directly associated with your identity, it will be treated as Personal Information under this Policy.

  • The areas within our Services that you visit and your activities there, including remembering you and your preferences;

  • Your Device characteristics;

  • To provide you with information about services (including electronic communications identifying optional Third Party Opportunities), changes to the Website, our Services, and/or our policies, and other information you may request;
  • To administer your account (including providing you with rewards);
  • To respond to your inquiries and personalize your experience on our Services (your information helps us to better respond to your individual needs);

  • For account verification and crediting purposes (and to provide you with proper tax forms);

Third Party Opportunities

By registering for an account with us, we will provide you access to Third Party Opportunities. These Third Party Opportunities include, but are not limited to: participating in surveys, exploring content and videos, shopping online, participating in various trials and offers, for which you can obtain various incentives, namely "CR Points", which can be redeemed for various rewards offered through our Services.

We may provide you with an encrypted User ID number ("User ID" and/or "Member ID") to participate in said Third Party Opportunities. The User ID does not contain any personally identifying information, and it is used by our Service for proper account crediting and identification.

You may optionally complete a detailed, in-depth, demographic profile for which will be used for the purposes of identifying and determining eligibility for Third Party Opportunities.

If you choose to participate in a Third Party Opportunity, each third party company or other provider of the third party opportunity (each defined as an "Advertiser") may contact you directly via various methods, such as email, phone, postal mail, or other means.

You may be required to provide Personal Information to said Third Party Opportunity in order to participate in the Third Party Opportunity.

Such Personal Information will be provided directly to the Advertiser, and will not be used or collected by us.

We are not responsible for the privacy policies or practices of Advertisers.

In no event will we sell or rent your Personal Information.

Contests, Promotions, and Sweepstakes

We may offer contests, promotions, and sweepstakes (each defined as a "Promotion"), through the Website and/or App that may require registration.

When choosing to participate in a Promotion, you agree to the official rules that govern said Promotion, which may include specific requirements. Requirements may include, but are not limited to, permitting the Promotion sponsor to use your name, likeness, and voice in marketing materials associated with the Promotion.

If you choose to register for a Promotion, Personal Information may be disclosed to third parties, or the public, in connection with administering said Promotion. This includes winner selection, prize fulfillment, and other requirements required by law, or permitted in the official rules of said Promotion.

5. How and When Do We Disclose Information to Third Parties?

a. General.

We may share Personal Information and Usage Information with third parties. We may share your Device Identifiers with third parties along with data related to you and your activities.

We do not share your Personal Information that we have collected directly from you on our Services with third parties for those third parties' marketing purposes unless you consent to such sharing at the time you provide your Personal Information.

In addition, we may share the information we have collected about you, including Personal Information, as disclosed at the time you provide your information and as described below or otherwise in this Policy.

b. When You Request Information From or Provide Information to Third Parties.

By registering for an account with us, we will provide you with access (through emails and other means) to Third Party Opportunities. If you choose to register for or participate in any Third Party Opportunities, each Advertiser may contact you directly by email, phone, postal mail, or other means, and you may be required to provide Personal Information in order to participate in the Third Party Opportunity.

If you choose to do so, your Personal Information and other information may be disclosed to each Advertiser (and their clients) and all information you disclose will be subject to the privacy policies and practices of such Advertisers.

In addition, Advertisers (and their clients) and other third parties may store, collect or otherwise have access to your information when you interact with their Tracking Technologies, content, tools apps or ads on the Website or link to them from the Website.

This may include using third party tools such as Facebook, X, TikTok, Pinterest or other third party posting or content sharing tools. We are not responsible for the privacy policies and practices of Advertisers or any other third parties and, therefore, you should review such third party privacy policies and practices of such third parties prior to requesting information from or otherwise interacting with them.

While we will not share your Personal Information with any Advertisers, we may share with Advertisers aggregate social-demographic, behavioral and other information about you, such as your User ID, postal code, gender, marital status, education, ethnicity/race (where permitted by applicable law), and employment related information.

Such information will be anonymized in a manner that will not permit any person other than you or us as the data subject or the source of the related data by implication or inference. Such information may be used by the Advertisers for: (a) identifying Third Party Opportunities that you may be eligible for through the Advertisers (including optional follow up Third Party Opportunities); (b) disclosing such information to clients of the Advertisers for audience measurement services; (c) appending such information to completed Third Party Opportunities and delivering the appended data to clients of the Advertisers for analytical or research purposes; (d) facilitating tracking of incentives upon completion of Third Party Opportunities and providing rewards; (e) flagging the User ID in cases of suspected fraudulent activity; and (f) such other uses set forth in the Advertisers' privacy policies. We do not have the ability to see your Third Party Opportunity responses unless provided by Advertisers for the purpose of investigating suspected fraudulent activity.

c. Third Parties Providing Services on Our Behalf.

We may use third party vendors to perform certain services on behalf of us or our Services, such as hosting our Services (Website and App), designing and/or operating the Service's features, tracking the Service's activities and analytics, and enabling us to perform other administrative services.

We may provide these vendors with access to user information, including Device Identifiers and Personal Information, to carry out the services they are performing for you or for us.

Third party analytics service providers may set and access their own Tracking Technologies on your Device and they may otherwise collect or have access to information about you, potentially including Personal Information, about you. We are not responsible for those third party technologies or activities arising out of them. We are not responsible for the effectiveness of or compliance with any third parties opt-out options.

d. Administrative and Legal Reasons.

We may access, use, preserve, transfer and disclose your information (including Device Identifiers and Personal Information), including disclosure to third parties: (a) to satisfy any applicable law, regulation, subpoenas, governmental requests or legal process if in our good faith opinion such is required or permitted by law; (b) to protect and/or defend the Terms of Service or our Services or other policies applicable to our Services, including investigation of potential violations thereof; (c) to protect the safety, rights, property or security of our Services or any third party; and/or (d) to detect, prevent or otherwise address fraud, security or technical issues. Further, we may use IP address or other Device Identifiers, to identify users, and may do so in cooperation with third parties such as copyright owners, internet service providers, wireless service providers and/or law enforcement agencies, including disclosing such information to third parties, all in our discretion, subject to applicable law. Such disclosures may be carried out without notice to you.

e. Affiliates and Business Transfer.

We may share your information, including your Device Identifiers and Personal Information, Demographic Information and Usage Information with our parent, subsidiaries, and affiliates. We also reserve the right to disclose and transfer all such information: (i) to a subsequent owner, co-owner or operator of the Services or applicable database; or (ii) in connection with a merger, consolidation, restructuring, the sale of substantially all of our interests and/or assets or other corporate change, including, during the course of any due diligence process.

a. California, Colorado, Connecticut, Virginia, Utah, etc.

You have certain rights pursuant to local state laws (including California Consumer Privacy Act of 2018 ("CCPA") regarding the Personal Information we collect about you. Our Services are operated in the United States. By providing us with any information or materials via our Services, you consent to the transfer and processing of your information and materials in the United States.

If you are located outside of the United States, please be aware that information we collect, including Personal Information, will be transferred to, and processed, stored and used in the United States.

e. Children.

Our Services do not offer products or services to children, and we do not knowingly collect any Personal Information from persons younger than the age of 18. We will delete all Personal Information collected that we later determine to be from a person younger than the age of 18.

f. Withdrawing your consent:

If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time.   • Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. Further note that it is not always possible to completely remove or delete all of your information from our databases and that residual data may remain on backup media or for other reasons.
7. Do Third Party Content and Links to Third Party Sites Appear on our Services?

Our Services may contain content that is supplied by a third party (including content in connection with Third Party Opportunities), and those third parties (including Advertisers) may collect Usage Information and your Device Identifier when pages from our Services are served to you.

In addition, when you are on our Services, you may be directed to other sites that are operated and controlled by third parties that we do not control. We are not responsible for the data collection and privacy practices employed by any of these third parties or their sites and they may be tracking you across multiple sites and may be sharing the results of that tracking with us and/or others.

Further, it is not always possible to completely remove or delete all of your information from our databases and that residual data may remain on backup media or for other reasons. 9. How Long Do We Keep Your Information?
